Preamble
These General Terms and Conditions of Sale, hereinafter the “Terms and Conditions”, govern the sale of products made through the Mandalashop website by:

These Terms and Conditions apply to orders placed by Consumer Customers and Professional Customers.
For the purposes of these Terms and Conditions:
• “Customer” means any natural or legal person placing an order with UNIWORLD;
• “Consumer Customer” means any natural person acting for purposes which are outside their trade, business, craft, liberal profession or agricultural activity;
• “Professional Customer” means any natural or legal person acting for purposes relating to their trade, business, craft, liberal profession or agricultural activity.
Provisions expressly reserved for Consumer Customers or Professional Customers apply only to the relevant category of Customer.
Placing an order implies acceptance of these Terms and Conditions in the version applicable on the date of the order.
Article 1 – Purpose and scope
These Terms and Conditions define the rights and obligations of UNIWORLD and the Customer in connection with the sale of products offered on the Mandalashop website.
They govern, in particular, the conditions relating to orders, payment, delivery, withdrawal, returns and warranties.
Mandatory statutory provisions applicable to Consumer Customers shall prevail over any conflicting provision of these Terms and Conditions.
For Professional Customers, these Terms and Conditions may be supplemented by specific terms, price lists, quotations or commercial agreements expressly agreed with UNIWORLD. In the event of a conflict, such specific terms shall prevail in respect of the provisions concerned.
Commercial terms specific to Professional Customers, including prices, minimum order amounts, any discounts, delivery charges and free-delivery thresholds, are those brought to their attention in the dedicated areas of the website or in the commercial documents applicable at the time of the order.
UNIWORLD may amend these Terms and Conditions at any time. The version applicable to an order is the version in force on the date the order is confirmed.
Article 2 – Products
Products offered for sale are those presented on the Mandalashop website, subject to availability or, for products manufactured or printed to order, subject to the conditions and lead times stated on the relevant product page.
2.1 – Product characteristics
The essential characteristics of each product are presented on its product page. The Customer is invited to review them before placing an order in order to ensure that the product meets their needs.
The dimensions, materials, colours, finishes, compositions and other characteristics stated are those known to UNIWORLD at the time they are published online.
Certain variations resulting from the nature of the materials or manufacturing processes may occur. They do not constitute a defect provided that they do not affect the essential characteristics stated, the conformity of the product or its normal intended use.
These provisions do not limit the Consumer Customer’s rights under statutory warranties.
2.2 – Photographs and representations
UNIWORLD takes the greatest care in presenting its products. However, colours may appear differently depending on the screen used, its calibration, brightness or the conditions in which photographs were taken.
Photographs and lifestyle images may include decorative items or accessories that are not supplied with the product. The contents of the offer are those stated on the product page.
Photographs and representations shall not have the effect of depriving the Customer of expressly stated characteristics or of their statutory rights in the event of a lack of conformity.
Article 3 – Orders and formation of the contract
3.1 – Ordering process
To place an order, the Customer selects the desired products and adds them to their shopping cart.
Before confirming the order, the Customer may check its contents, the total price, any delivery charges and the information entered, and may correct any errors. The Customer then selects from the available delivery and payment methods and accepts these Terms and Conditions.
Final confirmation of the order by means of a button or function clearly indicating that it entails an obligation to pay binds the Customer to payment of the order.
3.2 – Order confirmation
The order is taken into account once it has been confirmed by the Customer and, where immediate payment is required, subject to validation of that payment.
UNIWORLD sends the Customer an order confirmation by email containing information relating to the order and the applicable Terms and Conditions, in accordance with applicable regulations.
3.3 – Information provided by the Customer
The Customer must provide accurate and complete information necessary for processing, invoicing and delivery of the order and, where the Customer has an account, keep that information up to date.
UNIWORLD may refuse or cancel an order for a legitimate reason, including non-payment, fraud or attempted fraud, information preventing performance of the order, or an order that is manifestly abnormal. If an order that has already been paid for is cancelled, the amounts corresponding to products that will not be supplied will be refunded.
3.4 – Adding products to an order
As long as an order has not yet been processed or dispatched, the Customer may contact UNIWORLD to request that additional products be added to it.
Where the addition is still possible, UNIWORLD will send the Customer a payment link for the amount of the additional products. The addition will be taken into account once payment has been validated.
This option is subject to product availability and the stage reached in preparing the order. UNIWORLD cannot guarantee that a request to modify an order can be accommodated, particularly where preparation or dispatch has already begun.
Article 4 – Product availability
Products are offered for sale subject to availability. Where a product is shown as unavailable on the website, it cannot be ordered unless otherwise stated.
Despite the care taken in managing stock, an item may exceptionally prove unavailable after an order has been confirmed, particularly in the event of simultaneous orders, a stock discrepancy or a product that cannot be dispatched in satisfactory condition.
In such a case, UNIWORLD will inform the Customer as soon as possible. Depending on the circumstances, the Customer may obtain a refund for the unavailable product, wait for restocking where a reasonable timeframe can be given, or accept a replacement product offered by UNIWORLD.
No substitute product will be dispatched without the Customer’s prior agreement. Any price difference will be refunded or charged depending on whether the replacement product is less or more expensive.
Where only part of an order is unavailable, the remaining products may be maintained and dispatched.
Article 5 – Prices
5.1 – Applicable prices and charges
The prices applicable are those displayed when the order is confirmed.
For Consumer Customers, prices are stated in euros inclusive of all taxes (TTC). For Professional Customers with an approved professional account, prices are stated exclusive of tax (HT), to which VAT is added where applicable.
Delivery charges are not included in the product price unless otherwise stated. Their amount and the total price of the order are shown to the Customer before confirmation.
Professional prices, any discounts, minimum order amounts, delivery charges and free-delivery thresholds are those communicated in the professional area or in the commercial terms applicable at the time of the order.
5.2 – VAT and international sales
VAT is applied in accordance with applicable regulations, in particular according to the destination and the Customer’s status. The Professional Customer must provide the tax information required for the application, where appropriate, of a specific scheme or exemption.
For deliveries outside the relevant customs or tax territory, customs duties, import taxes or customs clearance charges may be payable at destination. Unless otherwise stated, these charges are not included in the price invoiced by UNIWORLD and remain payable by the Customer.
5.3 – Price changes, errors and promotions
UNIWORLD may change its prices at any time, without affecting orders that have already been confirmed.
In the event of an obvious pricing error resulting from a material or technical error which the Customer could not reasonably have failed to notice, UNIWORLD may cancel the order concerned and will refund any amounts already collected.
Promotions, discounts and promotional codes apply subject to the stated conditions and during the stated period. Unless otherwise indicated, they cannot be combined and must be used before the order is confirmed.
Article 6 – Payment and transaction security
6.1 – Payment methods
The price of the order is payable using the payment methods offered to the Customer when placing the order. These may vary according to the country, order amount or Customer status.
Unless specific terms have been expressly agreed with UNIWORLD, payment is due in full at the time of the order. Preparation and dispatch take place once payment has been validated.
Where instalment or deferred-payment solutions are offered, they are subject to the terms and acceptance criteria of the relevant payment provider. UNIWORLD does not guarantee their acceptance.
6.2 – Payment security and checks
Payments are processed using the secure systems of the payment service providers offered on the website. The Customer warrants that they are authorised to use the selected payment method.
To prevent fraud, UNIWORLD or its service providers may carry out checks and request information or supporting documents strictly necessary to verify a transaction.
UNIWORLD may suspend or refuse an order where payment is declined or incomplete, where the necessary checks cannot be carried out, or where there are serious indications of fraud. Where an order that has already been paid for is cancelled and no amount remains due, the amounts collected will be refunded.
6.3 – Provisions applicable to Professional Customers
Unless otherwise agreed in writing, orders placed by Professional Customers are payable immediately and in full. Where a payment period is exceptionally granted, the due date is specified on the invoice or in the specific terms agreed.
In accordance with Article L.441-10 of the French Commercial Code (Code de commerce), any late payment automatically and without prior reminder gives rise to late-payment penalties calculated at the interest rate applied by the European Central Bank to its most recent refinancing operation, increased by ten percentage points.
A Professional Customer in default of payment is also automatically liable for a fixed recovery charge of €40, in accordance with Articles L.441-10 and D.441-5 of the French Commercial Code. Where the recovery costs actually incurred exceed this amount, UNIWORLD may claim additional compensation upon providing supporting evidence.
6.4 – Invoicing
An invoice is issued in accordance with applicable regulations and is made available or sent to the Customer electronically.
Article 7 – Delivery and receipt
7.1 – Delivery methods, charges and times
Products are delivered to the address provided by the Customer or, where this option is offered, to the selected pickup point, parcel shop or locker. The Customer must check the accuracy of the delivery information provided.
Available delivery methods and charges are shown before the order is confirmed. For Professional Customers, any free-delivery thresholds and specific delivery conditions are those communicated in the professional area or in the applicable commercial terms.
UNIWORLD delivers products within the timeframe or on the date stated when the order is placed. If no timeframe or date is stated, orders placed by Consumer Customers will be delivered without undue delay and no later than thirty days after conclusion of the contract, in accordance with Article L.216-1 of the French Consumer Code (Code de la consommation).
In the event of late delivery, the Consumer Customer has the rights provided for in Articles L.216-1 et seq. of the French Consumer Code, including, under the conditions laid down by law, the right to terminate the contract.
7.2 – Transfer of risk
In accordance with Articles L.216-2 and L.216-3 of the French Consumer Code, the risk of loss of or damage to the products passes to the Consumer Customer when the Customer, or a third party designated by the Customer, takes physical possession of them.
Where the Customer independently chooses a carrier that is not offered by UNIWORLD, risk passes to the Customer when the goods are handed over to that carrier.
7.3 – Pickup point, uncollected parcel or failed delivery
Where delivery is made to a pickup point, parcel shop or locker, the Customer must collect the parcel within the period stated by the carrier. Merely making the parcel available does not constitute physical possession by the Consumer Customer.
Where a parcel is returned to UNIWORLD because the Customer provided an incorrect or incomplete address, failed to collect the parcel, or due to any other circumstance attributable to the Customer, the parcel may be resent at the Customer’s request, subject to payment of the new delivery charges.
Failure to collect a parcel does not, in itself, constitute exercise of the right of withdrawal.
If the Customer does not wish the parcel to be resent or fails to respond within a reasonable period, the order may be cancelled in accordance with applicable law. Where the delivery failure is attributable to the Customer, UNIWORLD may deduct from the refund the transport costs actually incurred as a result of that failure, where such deduction is legally justified and proportionate.
7.4 – Receipt, damage, missing or incorrect product
Upon receipt, the Customer is invited to check the condition of the parcel and the conformity of the products received.
In the event of a damaged, missing or incorrect product, or an apparent anomaly, the Customer is invited to contact UNIWORLD as soon as possible. UNIWORLD may request information and photographs reasonably necessary to process the claim.
In the event of damage in transit, the Customer is also invited, where possible, to retain the packaging and make precise reservations with the carrier.
After verification, UNIWORLD will, depending on the circumstances, send the missing or correct product, replace it or issue a refund. Any product sent in error will be returned at UNIWORLD’s expense where its return is requested.
Claims relating to a lack of conformity are handled in accordance with the article concerning statutory warranties.
7.5 – Professional Customers
The Professional Customer must check the condition, quantity and apparent conformity of the products upon receipt and report any anomaly to UNIWORLD as soon as possible, providing the information reasonably necessary to examine the claim.
Unless a mandatory statutory provision provides otherwise or UNIWORLD has expressly agreed in writing beforehand, late delivery cannot give rise to penalties or compensation that have not been expressly accepted by UNIWORLD.
The rules governing transfer of risk to Professional Customers arise from applicable law, the selected transport method and, where applicable, the specific terms agreed between the parties.
Article 8 – Statutory warranties
8.1 – Warranties applicable to Consumer Customers
Products sold to Consumer Customers benefit from the statutory guarantee of conformity provided for in Articles L.217-1 et seq. of the French Consumer Code and the statutory warranty against hidden defects provided for in Articles 1641 to 1649 of the French Civil Code (Code civil).

STATUTORY GUARANTEE OF CONFORMITY AND WARRANTY AGAINST HIDDEN DEFECTS
The consumer has a period of two years from delivery of the goods to obtain implementation of the statutory guarantee of conformity in the event that a lack of conformity appears. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.
Where the contract for the sale of the goods provides for the continuous supply of digital content or a digital service for a period exceeding two years, the statutory guarantee applies to that digital content or digital service throughout the scheduled supply period. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.
The statutory guarantee of conformity requires the professional, where applicable, to provide all updates necessary to maintain the conformity of the goods.
The statutory guarantee of conformity entitles the consumer to repair or replacement of the goods within thirty days of the request, free of charge and without major inconvenience.
Where the goods are repaired under the statutory guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee.
Where the consumer requests repair of the goods but the seller requires replacement, the statutory guarantee of conformity is renewed for a period of two years from the date on which the goods are replaced.
The consumer may obtain a reduction in the purchase price while retaining the goods, or terminate the contract and receive a full refund against return of the goods, if:
1° the professional refuses to repair or replace the goods;
2° repair or replacement takes place after a period of thirty days;
3° repair or replacement causes major inconvenience to the consumer, in particular where the consumer definitively bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
4° the lack of conformity persists despite the seller’s unsuccessful attempt to bring the goods into conformity.
The consumer is also entitled to a reduction in the price of the goods or termination of the contract where the lack of conformity is so serious as to justify an immediate price reduction or termination. In such a case, the consumer is not required to request repair or replacement of the goods beforehand.
The consumer is not entitled to terminate the sale where the lack of conformity is minor.
Any period during which the goods are immobilised for repair or replacement suspends the remaining guarantee period until delivery of the repaired goods.
The rights referred to above result from the application of Articles L.217-1 to L.217-32 of the French Consumer Code.
A seller who, in bad faith, obstructs implementation of the statutory guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover, in accordance with Article L.241-5 of the French Consumer Code.
The consumer also benefits from the statutory warranty against hidden defects under Articles 1641 to 1649 of the French Civil Code for a period of two years from discovery of the defect. This warranty entitles the consumer to a reduction in price if the goods are retained or to a full refund against return of the goods.
8.2 – Implementation of warranties
To make a warranty claim, the Customer may contact UNIWORLD at contact@mandalashop-online.com, stating the order number and the issue encountered. UNIWORLD may request any information, photographs or evidence reasonably necessary to examine the claim.
Where a return is necessary and the statutory warranty applies, the corresponding costs are not payable by the Consumer Customer.
Damage resulting in particular from misuse, an accident, negligence or modification of the product does not constitute a lack of conformity where it is the cause of the issue identified.
Variations inherent in materials or manufacturing processes do not constitute a defect where they remain compatible with the stated characteristics and the normal intended use of the product.
8.3 – Professional Customers
Professional Customers benefit from the warranties provided for by the French Civil Code and, where applicable, any specific warranties expressly agreed with UNIWORLD.
Article 9 – Right of withdrawal
9.1 – Withdrawal period
In accordance with Article L.221-18 of the French Consumer Code, the Consumer Customer has fourteen days from receipt of the product by the Customer, or by a third party designated by the Customer other than the carrier, to exercise the right of withdrawal without having to give any reason.
Where an order concerns several products delivered separately, the period runs from receipt of the last product.
9.2 – Exercising the right of withdrawal
In accordance with Article L.221-21 of the French Consumer Code, the Customer must inform UNIWORLD of the decision to withdraw before expiry of the fourteen-day period.
The Customer may exercise this right using the withdrawal functionality made available on the website, the form set out at the end of this article, or any other unambiguous statement expressing the wish to withdraw.
Where withdrawal is exercised online, an acknowledgement of receipt is sent to the Customer on a durable medium in accordance with applicable statutory provisions.
9.3 – Returning products
In accordance with Article L.221-23 of the French Consumer Code, the Customer must return the products no later than fourteen days after communicating the decision to withdraw.
Before making any return, the Customer must contact UNIWORLD to obtain return instructions and the address to which the products must be sent. Products must be sent to the return address communicated by UNIWORLD.
The direct cost of returning the products is payable by the Customer and is not reimbursed by UNIWORLD.
The Customer is liable for any diminished value of the product resulting from handling other than that necessary to establish its nature, characteristics and proper functioning.
9.4 – Refund
In accordance with Article L.221-24 of the French Consumer Code, UNIWORLD refunds the Customer the price of the returned products and the initial delivery charges paid, up to the cost of the least expensive standard delivery method offered when the order was placed.
If the Customer selected a more expensive delivery method, the additional cost resulting from that choice is not refunded.
The costs incurred by the Customer in returning the products to UNIWORLD remain payable by the Customer and are not reimbursed.
The refund is made no later than fourteen days from the date on which UNIWORLD is informed of the decision to withdraw. UNIWORLD may, however, defer reimbursement until the products have been recovered or until the Customer provides evidence that they have been dispatched, whichever occurs first.
The refund is made using the same payment method as that used for the order, unless the Customer expressly agrees to another method that does not result in any fees.
9.5 – Exceptions to the right of withdrawal
In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal may not, in particular, be exercised in respect of products made to the Customer’s specifications or clearly personalised.
The fact that a standard product from the Mandalashop catalogue is manufactured or printed after the order is placed is not, in itself, sufficient to exclude the right of withdrawal where the product has not been personalised at the Customer’s request.
9.6 – Professional Customers
The right of withdrawal provided for in this article is reserved for Consumer Customers, subject to specific circumstances in which the law also grants a right of withdrawal to certain professionals.

Article 10 – Liability
10.1 – Use of products
UNIWORLD is responsible for proper performance of its obligations in accordance with applicable regulations.
The Customer must use the products in accordance with their intended purpose, characteristics and, where applicable, any precautions or instructions for use provided.
UNIWORLD cannot be held liable for damage resulting from abnormal or inappropriate use of a product, failure to comply with precautions for use, modification of the product by the Customer, or an external cause not attributable to UNIWORLD.
These provisions do not limit statutory warranties or the mandatory rights of Consumer Customers.
10.2 – Information relating to well-being and symbols
Information presented on Mandalashop concerning, in particular, symbols, sacred geometry, crystal healing, energy practices, harmonisation or well-being practices is provided for informational and cultural purposes.
It does not constitute medical advice, a diagnosis or treatment and is not a substitute for consultation with a healthcare professional.
UNIWORLD does not guarantee any particular result associated with the symbolic, energetic or traditionally attributed properties of the products.
10.3 – Professional Customers
In relations with Professional Customers and to the extent permitted by law, UNIWORLD is liable only for direct and foreseeable loss resulting from a breach attributable to it.
Indirect loss, including loss of business, turnover, customers, data or profits, shall not give rise to compensation, except where a mandatory statutory provision provides otherwise or in the event of gross negligence or wilful misconduct.
Article 11 – Force majeure
In accordance with Article 1218 of the French Civil Code, neither party may be held liable for failure to perform its obligations where such failure results from an event of force majeure beyond its control, which could not reasonably have been foreseen when the contract was concluded and whose effects cannot be avoided by appropriate measures.
Where the impediment is temporary, performance of the affected obligations is suspended for its duration, unless the resulting delay justifies termination of the contract.
Where the impediment is permanent, the contract is automatically terminated under the conditions provided by law.
Article 12 – Intellectual property
All elements appearing on the Mandalashop website, including graphic creations, illustrations, photographs, visuals, texts, descriptions, logos, distinctive signs, layouts and content, are protected by applicable intellectual property rights.
Unless UNIWORLD has given prior authorisation or an exception is provided by law, any reproduction, representation, adaptation, modification, distribution or exploitation, in whole or in part, of these elements is prohibited, in particular pursuant to Article L.122-4 of the French Intellectual Property Code (Code de la propriété intellectuelle).
12.1 – Use by Professional Customers
Purchasing Mandalashop products for resale does not grant the Professional Customer any automatic right to use Mandalashop photographs, visuals, graphic creations or texts.
Any Professional Customer wishing to use such elements to present or promote the products they resell must obtain UNIWORLD’s prior authorisation.
Where granted, such authorisation is personal, non-exclusive and limited to the promotion and sale of the relevant Mandalashop products. It does not permit substantial modification of the supplied elements, their use for other products or brands, or their transfer or provision to third parties without prior authorisation.
UNIWORLD may require the cessation of any unauthorised use or any use that does not comply with the conditions under which authorisation was granted.
12.2 – Mandalashop trademark and identity
Any use of the Mandalashop name, trademark or identity must respect the brand image and must not create confusion as to the existence of any partnership, exclusivity, affiliation or official representation that has not been expressly granted by UNIWORLD.
Article 13 – Resale conditions for Professional Customers
13.1 – Resale of products
Professional Customers acting as resellers market Mandalashop products in their own name and for their own account, as independent professionals.
They are responsible for complying with the legal and regulatory obligations applicable to their own activity and to the marketing of products to their customers.
13.2 – Resale prices
UNIWORLD provides Professional Customers with recommended resale prices corresponding to the retail prices applied on the Mandalashop online shop, excluding promotions, temporary offers or specific commercial operations.
These recommended resale prices constitute the pricing reference recommended by UNIWORLD in order to maintain consistent positioning of Mandalashop products and the Mandalashop brand for consumers.
They are, however, provided for guidance only. Each Professional Customer remains free to determine their resale prices in accordance with applicable competition rules.
The recommended prices communicated by UNIWORLD therefore do not constitute fixed or minimum resale prices.
13.3 – Presentation and promotion of products
The Professional Customer undertakes to market and present Mandalashop products in a manner that respects their identity, integrity and the image of the brand.
In particular, the Professional Customer undertakes:
• not to remove, conceal, modify or alter the Mandalashop trademark, logo, labels, markings, notices, packaging or any other identification element affixed to or supplied with the products;
• not to repackage, transform or modify the products in a manner liable to alter their presentation, characteristics, quality or identification, except with UNIWORLD’s prior written consent;
• not to present or market a Mandalashop product under another brand, under the Professional Customer’s own name, or in a manner liable to suggest that the Professional Customer is its manufacturer or creator;
• not to associate Mandalashop products or the Mandalashop brand with false or misleading information or information liable to harm the image, reputation or positioning of the brand;
• to respect the essential characteristics of the products and not attribute to them properties, compositions, origins or warranties that are not stated by UNIWORLD;
• not to use the Mandalashop brand in a manner liable to create confusion as to the existence of a partnership, exclusivity, approval or official representative status that has not been expressly granted by UNIWORLD.
Where products are resold in Mandalashop packaging or with Mandalashop presentation materials, these must be retained in their original presentation, except where required by law, where damaged, or with UNIWORLD’s prior agreement.
Use of photographs, visuals, texts, graphic creations and other content belonging to UNIWORLD remains subject to Article 12 of these Terms and Conditions.
13.4 – Promotions and commercial operations
The Professional Customer remains free to determine their commercial and promotional policy in accordance with applicable regulations.
UNIWORLD may occasionally invite resellers to participate in joint commercial or promotional operations. Unless a specific agreement is expressly concluded between the parties, participation in such operations remains optional.
13.5 – No exclusivity
Unless otherwise agreed in writing, opening a professional account and purchasing Mandalashop products does not grant the Professional Customer any territorial, geographical or commercial exclusivity.
UNIWORLD remains free to market its products directly or through other resellers, platforms or partners.
Article 14 – Personal data
As part of its business, UNIWORLD may collect and process personal data relating to its Customers, in particular for managing customer accounts, orders, payments, deliveries, invoicing and customer service, as well as for complying with its legal obligations and, where permitted by law, sending marketing communications.
Data is processed in accordance with the General Data Protection Regulation (GDPR) and applicable French legislation. It may be accessed by authorised persons within UNIWORLD and by service providers to whom transmission is necessary for the performance of the relevant services, including payment, delivery, hosting and technical service providers.
Data is retained for no longer than is necessary for the purposes for which it was collected, subject to retention or archiving periods required or permitted by applicable regulations.
In accordance with applicable regulations, any data subject may, subject to the conditions laid down by law, exercise their rights of access, rectification, erasure, restriction, objection and data portability, and may withdraw consent where processing is based on consent.

Any data subject also has the right to lodge a complaint with the French Data Protection Authority (Commission nationale de l’informatique et des libertés – CNIL).

Article 15 – Governing law and dispute resolution
15.1 – Governing law
These Terms and Conditions and contracts entered into with UNIWORLD are governed by French law.
For Consumer Customers residing in another country, this choice of law may not, however, deprive them of the protection afforded by mandatory provisions of the law of their country of residence where those provisions apply under the rules of private international law, in particular Article 6 of Regulation (EC) No 593/2008 of 17 June 2008 (“Rome I”).
15.2 – Amicable resolution
In the event of a difficulty or dispute relating to an order, the Customer is invited to contact UNIWORLD beforehand in order to seek an amicable solution.
The Consumer Customer may also use the consumer mediation scheme free of charge under the conditions set out in Article 16 of these Terms and Conditions.
15.3 – Competent courts
If no amicable solution is reached, any dispute shall fall within the jurisdiction of the competent courts in accordance with applicable legal rules.
A Consumer Customer may, in particular, bring proceedings before one of the courts having territorial jurisdiction under the French Code of Civil Procedure or before the court for the place where the Consumer Customer resided when the contract was concluded or when the harmful event occurred, in accordance with Article R.631-3 of the French Consumer Code.
For Professional Customers, the applicable rules on jurisdiction are those provided by law, unless a jurisdiction clause or specific agreement has been validly entered into between the parties.
Article 16 – Consumer mediation
In accordance with Articles L.612-1 et seq. of the French Consumer Code, the Consumer Customer has the right to use a consumer mediator free of charge with a view to the amicable resolution of a dispute with UNIWORLD.
Before referring the matter to the mediator, the Customer must first have submitted a complaint to UNIWORLD in an attempt to resolve the dispute directly.
If no amicable solution is reached, the Consumer Customer may refer the matter to the mediator appointed by UNIWORLD:

Use of mediation is free of charge for the Consumer Customer, without prejudice to any costs that the Customer may personally decide to incur under the conditions provided by applicable regulations.
The Customer remains free to accept or refuse mediation and retains the right to bring proceedings before the competent courts.
Article 17 – General provisions
17.1 – Severability
If any provision of these Terms and Conditions is declared void, unenforceable or deemed unwritten, the remaining provisions shall remain applicable, unless the provision concerned constituted a determining element of the parties’ commitment.
17.2 – No waiver
Failure by UNIWORLD or the Customer at any time to rely on any provision of these Terms and Conditions shall not be interpreted as a waiver of the right to rely on that provision subsequently.
17.3 – Language of the Terms and Conditions
These Terms and Conditions are drafted in French and may be translated into other languages for the purposes of the Mandalashop website.
In the event of any discrepancy in interpretation between the French version and a translated version, the French version shall prevail, subject to applicable mandatory provisions, in particular the rights enjoyed by a Consumer Customer under the law of their country of residence where applicable.
